To use the site, you are agreeing to comply with and be bound to the following terms and conditions of use, which govern Hawaii Homebids.com's relationship with you and its website. The terms "Hawaii Homebids.com" or "we" refer to the owner of the website.  The term "you" refers to the user or viewer of Hawaii Homebids.com

All site users shall act with honesty and with integrity while on the site; otherwise their user privileges shall be revoked. The wining bidder shall review and adhere to the terms of the Purchase Contract for the property listed on site. Hawaii Homebids.com may suspend your account, and seek legal remedies, it at anytime suspects that either as a buyer or seller, you have committed or engaged in fraud or fraudulent activities relating to the transaction on site. Any bidders found making fraudulent bids on the site or defaulting on a property they have won, shall be banned from the site, without any recourse and subject to legal remedies per the Purchase Contract. Because Hawaii Homebids.com deals with the buying and selling of real estate, our services are not available to minors or any individuals who cannot form legally binding contracts under applicable law.

All properties listed on Hawaii Homebids.com shall be offered subject to the Sellers' approval of price, final terms, and conditions. Seller is represented by Hawaii Homebids.com and is obligated as the Sellers Agent to represent the Sellers best interest. Properties are sold AS IS, WHERE IS and WITH ALL FAULTS. On site inspections by appointment or during designated open houses is recommended.  Properties sold may be subject to easements, zoning, encroachments, restrictions and other matters of record. The properties are offered through an on-line bidding process with specific open and close dates. Prospective bidders may view general information about a property by clicking the links to the Property Bid page. Virtual tour of the property may also be available by clicking on additional links. Buyer must apply and deliver to Hawaii Homebids.com a pre-approved loan certification prior to bidding.  Buyer is not represented by Hawaii Homebids.com and is a customer to the Purchase Contract. Buyer may seek representation; however Seller will not pay commission to Buyer's broker. The winning bid shall become binding and fully executed contract when both Buyer and Seller sign the Purchase Contract.

To effectively use the site, registration is necessary to list the property, view properties and place bids. Seller and Bidder information and password information is confidential and may not be shared or transferred to another party. Buyer and Seller agree to remain on the website as Registered Seller or Buyer until the expiration date. Should you default in your terms or bid, you may be banned from future use of the site.

Hawaii Homebids.com reserves the right to change our Terms and Conditions of the site at any time relating to fees and other terms mentioned or not mentioned in this document.  We may in our sole discretion change any or all of our services at any time. If a change occurs in a particular service, the fees for that service are effective at the introduction of that service. If there are any discrepancies between the Purchase Contract and the terms and conditions outlined in this site, the Purchase Contract shall prevail.
